Sanjay, could you paste the latest judgement given by the Supreme Court regarding the disclosure of the 2010 UPSC Preliminary Examination marks, has the Union Public Service Commission been instructed by the SC to disclose the marks of all the candidates or of the aggrieved ones who filed the writ petition?


Union Public Service Commission didn't declare cut off marks inspite of losing case in Suprme Court. Union Public Service Commission is replying that declaring cut off and individual marks is under consideration. An another application for contept of court is going to be filed on 03/01/2011 as Supreme Court is enjoying Christmas vacation.

UPON hearing counsel the Court made the following
O R D E R
The issue raised in this SLP was earlier
decided by the Delhi High Court against the
respondent, the Union Public Service Commission
(vide judgment and order dated 17.4.2007 passed by
a single judge of the Delhi High Court in writ
petition (C) No.17583 of 2006 and affirmed by the
Division Bench of the High Court by Judgment and
Order dated 3.9.2008 in LPA No.313 of 2007).
In the case of the petitioner the Delhi
High Court refrained from passing any order
observing that the Union Public Service Commission
had filed SLP(C) No.23250 of 2008 against its
order dated 3.9.2008 in LPA No.313 of 2007 and in
that SLP this Court had granted stay against the
operation of its judgment.
During the pendency of the earlier case
(SLP(C) No.23250 of 2008) the Union Public Service Commission changed the
format of its examination for the Central
Services. Hence, when the earlier SLP came up for
hearing this Court dismissed it observing that
there was no need for any adjudication by this
Court in the matter since the Union Public Service Commission had changed the
pattern of its examination.
That being the position the order passed by
the Delhi High Court in the earlier case holds the
field and the case of the present petitioner will
also be governed by that order.
This SLP is disposed of with the aforesaid
observations and directions.

Civil services aspirants ask Union Public Service Commission to reveal marks

NEW DELHI: Aspirants preparing for the Civil Services examinations have demanded that the Union Public Service Commission reveal marks attained by applicants who appeared for the Preliminary examination in 2010 in line with the Supreme Court order of December 3 in response to a special leave petition filed by aggrieved candidates.
The candidates had earlier organised a 52-day protest at Jantar Mantar here demanding that the Union Public Service Commission publish the marks attained in the preliminary exam, alleging that over 4,000 deserving candidates were denied a chance to take the Main test.
They said a human or technical error ended up restricting the number of candidates who qualified to just 12,394 despite there being 965 notified vacancies. In contrast in 2009, they said, 12,800 students qualified though there were just 585 vacancies.
The Supreme Court in its order had directed the Union Public Service Commission to follow the order by a Single Judge of the Delhi High Court in 2006 which was later affirmed by a Division Bench of the High Court in 2008.
The Supreme Court order will require the Union Public Service Commission to disclose within two weeks the marks assigned to all aspirants in the preliminary examination.

Civil Services aspirants held a protest outside the Union Public Service Commission office on Monday demanding that the Union Public Service Commission honour the Supreme Court order of December 3 to release the marks attained by applicants who appeared for the Preliminary examination in 2010, in response to a special leave petition filed by aggrieved candidates.
The aspirants said they would approach the Supreme Court again asking it to take up contempt of court proceedings against the Union Public Service Commission for not releasing the marks of the candidates. The Civil Services aspirants said they would also file a writ petition in the Delhi High Court seeking stay of publication of the results of the 2010 Mains examination until Union Public Service Commission releases the results of the 2010 Preliminary examination.
